Milwaukee Journal-Sentinel | Fischer: Senate doesn’t have to confirm

WILL Senior Counsel Mike Fischer writes in the Milwaukee Journal-Sentinel:

“Justice Antonin Scalia hardly would be surprised by the fact that his tragic and untimely death led almost instantaneously to a political free-for-all over the question of his successor. As he explained in a 2004 speech to the Philadelphia Bar Association, “as long as judges tinker with the Constitution to ‘do what the people want,’ instead of what the document actually commands, politicians who pick and confirm new federal judges will naturally want only those who agree with them politically.””
