Yesterday, WILL filed a brief with the Public Service Commission in the streetcar case brought by Brett Healy of the John K. MacIver Institute for Public Policy. The brief argues that because the streetcar would be a “proprietary” governmental function (one that engages in economic activity like a private business would), Milwaukee cannot pass on the $60 million or more in estimated utility relocation costs to the utilities owning facilities underneath the proposed route. If Milwaukee wants a streetcar, they have to pay for it with their own taxpayers’ money, not by shifting the cost onto people who will not benefit from it and have no political say in whether it is built.
